Sub: Request for speedy trial of subjudice case, TC(c) 98/2012, to end the agony of over 1 lac young
doctors.
With all due respect , we the medical PG aspirants of our country , want to state our plight in front of
the apex court that the undue pendency of case TC(C)98/2012 which is subjudice in the Court of
Hon’ble CJI, has become a reason of mass agony for the skillful yet helpless Medical PG aspirant lot of
our country ,as we are awaiting the verdict, after which only, the NEET PG -2012 results have to be
declared as stated by the Hon’ble Court in Order dated 13/12/2012 and posted on MCI website.
We believe in the epitome of justice of our country ,hence we as Sankalp Medicos Movement
Association , entered into the court with our plight only to be stated in front of our hon’ble Court
believing immensely in the power of patience and positive approach awaiting for our time to come.
But resilience of the young doctors is on the verge of breaking point now , since the long wait for mere
hearings in court for such a case where the plight of a huge number of doctors - over 40,000 Junior
Residents which have to be appointed after the declaration of NEET results , future of 95,000 PG
aspirants who gave NEET PG -2012 , and future of those unfortunate PG aspirants who might not qualify
NEET PG -2012 & also those who have to sit for examination in hope for passing the next examination in
the coming future ,where number amounts to be more than 1 lac owing to the addition into the total
population aspiring for higher Medical education in our country every year, is at stake and grave risk of
losing all hopes. We are looking eagerly towards the highest temple of justice for putting an end to this
agony of learned skillful youth of our country ,and are pleading to give us a fair verdict soon.
We are the sole sufferer in this tussle over NEET and we feel like abandoned masses now ,due to the
delay in the hearings. It is Hon’ble Court’s direction only that new sessions have to be started every
year by 1st of June but looking to the present scenario, this seems to be a distant dream for us .
With a short letter as a grieving plea to your kind authority , and as an undying hope in the judiciary of
our country we again want to request you to take the issue of NEET in houses for discussion and also
the issue of undue pendency of TC(C) 98/2012 and to give a helping hand to the helpless student
medicos in getting the most awaited verdict to avoid the further pendency into the justice that we are
seeking for since long while taking into consideration that “the regulations framed by Hon’ble Court
itself for strict adherence to time schedule in admission to various courses by institutes, which does not
permit admission to PG courses beyond 31st of May every year” too are followed.

Eligibility:-

Nationality

A candidate must be either:-

(a) a Citizen of India, or
(b) a subject of Nepal, or
(c) a subject of Bhutan, or
(d) a Tibetan refugee who came over to

India before the 1st January, 1962 with the intention of permanently settling in India. or (e) a person of Indian origin who has migrated from Pakistan, Burma, Sri Lanka or East African Countries of Kenya, Uganda, the United Republic of Tanzania, Zambia, Malawi, Zaire and Ethiopia or from Vietnam with the intention of permanently settling in India.

Provided that a candidate belonging to categories (b), (c), (d) and (e) above shall be a person in whose favour a certificate of eligibility has been issued by the Government of India.

A candidate in whose case a certificate of eligibility is necessary, may be admitted to the examination but the offer of appointment may be given only after the necessary eligibility certificate has been issued to him by the Government of India.

Age Limit:-

(a) A candidate for this examination must not have attained the age of 32 years as on 1st January, 2012, i.e. the candidate must have been born not earlier than 2nd January, 1980.

(b) The upper age limit is relaxable as follows.

(i) Upto a maximum of five years if a candidate belongs to a Scheduled Caste or a Scheduled Tribe.

(ii) Upto a maximum of three years in the case of candidates belonging to Other Backward Classes who are eligible to avail of reservation applicable to such candidates.

Educational Qualification:-

For admission to the examination a candidate should have passed the written and practical parts of the final M.B.B.S. Examination.

NOTE:- A candidate who has appeared or has yet to appear at the final M.B.B.S. Examination may also apply. Such candidates will be admitted to the examination if otherwise eligible but the admission would be deemed to be provisional and subject to cancellation, if they do not produce proof of having passed the written and practical part of the final M.B.B.S. Examination along with the detailed application which will be required to be submitted to the Commission by the candidates who qualify on the result of the written part of the examination.

CMS Exam Pattern:-

The examination shall be conducted according to the following plan:-

Part-I

WRITTEN EXAMINATION - (500 marks)

The candidates will take the written examination in two Papers, each Paper carrying a maximum of 250 marks. Each Paper will be of two hours duration.

Part-II

Personality Test : (100 Marks):
Personality test carrying 100 marks of

such of the candidates who qualify on the results of the written examination.

(A) Written Examination:-

2. The written examination in both the papers will be completely of objective (Multiple choice answer) type. The question Papers (Test Booklets) will be set in English only.

3. Candidates must write the Papers in their own hand. In no circumstances will they be allowed the help of a scribe to write answers for them.

4. The Commission have discretion to fix qualifying marks in any or both the papers of the examination.

5. Penalty for wrong answers There will be penalty (Negative Marking) for wrong answers marked by a candidate in the objective type question papers.

(i) There are four alternatives for the answers to every question. For each question for which a wrong answer has been given by the candidate, one third (0.33) of the marks assigned to that question will be deducted as penalty.

(ii) If a candidate gives more than one answer, it will be treated as a wrong answer even if one of the given answers happens to be correct and there will be same penalty as above for that question.

(iii) If a question is left blank i.e. no answer is given by the candidate, there will be no penalty for that question.

6. Candidates are not permitted to use calculators for answering objective type papers. They should, therefore not bring the same inside the Examination Hall.

PERSONALITY TEST - (100 marks):

Candidates who qualify in the written examination will be called for Interview/ Personality Test to be conducted by the Union Public Service Commission. The Interview/Personality Test will carry 100 marks.

The interview for Personality Test will be intended to serve as a supplement to the written examination for testing the General Knowledge and ability of the candidates in the fields of their academic study and also in the nature of a personality test to assess the candidate's intellectual curiosity, critical powers of assimilation, balance of judgment and alertness of mind, ability for social cohesion, integrity of character, initiative and capability for leadership.

The Medical Council of India (MCI) does not regulate Paramedical Education. So far as medical students are concerned, in order to encourage medical graduates to work in remote and difficult areas, the Medical Council of India with the previous approval of Central Government has amended the Post Graduate Medical Education Regulations, 2000 to provide –

(i) 50% reservation in Post Graduate Diploma Courses for Medical Officers in the Government service who have served for at least three years in remote and difficult areas; and

(ii) Incentive at the rate of 10% of the marks obtained for each year in service in remote or difficult areas upto the maximum of 30% of the marks obtained in the entrance test for admissions in Post Graduate Medical Courses.

Government is contemplating to make rural service mandatory for MBBS graduates.

In order to meet the shortage of health/paramedical professionals in the country, the Central Government has already taken various measures which inter-alia include

(i) Relaxation in the norms for setting up of a medical college in terms of requirement for land, bed/bed strength, etc. particularly in underserved/hilly/tribal areas. 
(ii) Decision to introduce Bachelor of Science (Community Health) course.
(iii) Setting up of new medical colleges in underserved areas in particular. 
(iv) Financial support under National Rural Health Mission for engagement of staff on contractual basis. 
(v) Financial assistance to strengthen and upgrade the teaching institutions for nurses and paramedical personnel. 


The above information was given by the Union Minister for Health & Family Welfare, ShriGhulamNabi Azad in a written reply to a question in the LokSabha today.

LUCKNOW: The state government may postpone the UP Post Graduate Medical Entrance Exam for three weeks considering the agreement reached between the striking medical students and district administration. Admitting that district magistrate Anurag Yadav, who was negotiating with thestriking students, has forwarded the proposal to the state government, principal secretary, JP Sharma said the government may take a decision on March 28. But, he stated that till government takes the decision, UPPGMEE would be held as per schedule on March 31.


Medical students had been agitating for last several days demanding cancellation of UPPGMEE. They wanted the government to consider NEET (National Eligibility cum Entrance Test) scores for admissions in post graduate medical courses in the state. Organised by the Medical Council of India, NEET was held in November and December 2012 and was later caught in a legal dispute, pending with the apex court and may be decided over the next three weeks.

After being taken into custody by the district administration, thestriking medical students were detained at the Lucknow reserve police lines. While the ailing students, who took ill due to hunger strike, were hospitalised, student leaders were called for a meeting with DM Anurag Yadav at the police lines. 

In the three hours long meeting, a consensus was achieved when the issues raised by the students were sorted in point-wise. 

At the end of the meeting, the following points were noted and which indicate Uttar Pradesh government's stand on the issue. 



UP is not in favour of NEET: Striking students had been claiming that the UP government had agreed to admit students on the basis of score obtained in NEET. "It has been misconstrued. We were the first to oppose NEET but thought we would give things a chance so that the best interest of the students could be safeguarded. At that point in time, we felt letting students take NEET was good. Later, when the confusion over the issue appeared to be far from a conclusion and the apex court directed states to go ahead with the state exam, we notified about it" said JP Sharma. He clarified that going with NEET would mean losing a significant chunk of seats because they were not recognised. NEET would also limit the possibility of admitting government doctors against diploma courses. 



UP not alone to hold PGMEE: UP is not the only state to be holding its post graduate medical entrance exam. Sources in the medical education department informed that Andra Pradesh, Karnataka, Tamil Nadu and CMC Vellore have already organised their entrance exams. In Gujarat, the exam is slated to take place on April 27 but the fate of the exam is not certain as students are agitating against the exam. Notifications have been issued in Jharkhand and Jammu and Kashmir. The states of Bihar and Orissa are also likely to hold their exams soon. States of Assam and Madhya Pradesh notified their state exams but later cancelled it on account of students' protest. Only states of Punjab, Kerala, Air Force Medical College Pune, Manipur and Goa have decided to go ahead with NEET only. The stand of Maharashtra and West Bengal governments is not clear. 



'NEET isn't an umbrella exam': NEET is touted as an umbrella exam that would save students from taking tens of exams in different parts of the country. But senior officials in the medical education department claimed that NEET was not the answer to all other exams. "The All India Institute of Medical Sciences, Post Graduate Institute of Medical Sciences Chandigarh, JIPMER Pudducherry was holding their separate exams," he stated. Officials also stated that since NEET was replace majority of the exams, a student who misses the chance, would end up wasting the entire year. Citing previous experience, the officials stated that many students from UP who didn't fare well in All India exam were able to get a seat for themselves in the state exam. 



Disagreement over pattern of NEET: The scoring in NEET PG took into account results psychological analysis of each student. The officials in UP believe that the parameter would give a chance for manipulation. They also stated that during the National Eligibility cum Entrance Test(NEET) was observed that many questions given to the students were repeated. Therefore, the difficulty level of the exam deteriorated with each passing day of the exam that took place over two weeks between November 23 and December 6. The officials also said that repetition of questions could not be avoided as the syllabus of a subject is fixed; therefore, there is a limit to how many questions one can cull out of the content.

Interns, JRs strike work at GSVM

KANPUR: After another short round of strike late on Monday night, the emergency and put-patient department (OPD) services atGaneshShankarVidyarthi Memorial Medical College (GSVM) normalized on Tuesday morning. The GSVM authorities reportedly forced the interns and junior doctors to call off their strike by giving them references of their results and public support.

After boycotting emergency services late on Sunday night and forcibly closing the OPD on Monday morning, the interns and JRs of GSVM Medical College again struck work at around 9.30 pm on Monday. This time the strike was short and was called off around 3 am on Tuesday after the intervention of senior GSVM authorities who reportedly pointed out to the interns threat to their career and public outcry.

According to sources, the interns who were back to work on Monday afternoon, got irked by the presence of a huge posse of police on the LLR and GSVM campus. The students said it was done to pressurize them and struck work in the night.

After the strike which started around 9.30 pm on Monday night, the students refused to admit three critically ill patients who were brought to the Emergency. The Emergency Medical officer (EMO) informed Dr Navneet Kumar, Principal and dean of GSVM about the incident.

The principal acted tough and ordered normalizing of the Emergency services.

  Students claimed that the GSVM authorities raised the issue of results to pressurize them. The dean also reportedly told the students that they will lose public support if the strike continued. After a long talk between the authorities and the students, the latter agreed to call off the strike around 3 am. The OPD at LLR also commenced smoothly on Tuesday morning.

With an aim to supporting their colleagues protesting on the issue of UPPGMEE in Lucknow, the interns and PG students of GSVM boycotted medical services here on Monday. They forcibly closed the OPD while the emergency services were also crippled for more than three hours late on Sunday night.

The students were demanding cancellation of UPPGMEE on the grounds that they had already taken the National Eligibility-Cum-Entrance Test (NEET).
