HC relief to in-service doctors

Bombay High Court (HC) told the state government Thursday to put on hold a "last-minute" resolution denying 25 per cent reservation in PG medical courses to doctors who have served in rural areas.
HC was hearing a bunch of petitions by in-service doctors challenging the government resolution of July 2 allowing quota in PG diploma courses but not in PG degree courses.
Justices V M Kanade and K R Shriram questioned the change of rule. It said such last-minute changes created uncertainty and frustrated students. The petitioners cited provisions of law that require the government to make such policy changes at least six months before the start of PG courses.

hi this is dr prashant meshram,I was one of the those non-in-service/fresh candidates who put up an intervention against in-service candidates case..

it saddens me that your blog neet updates is propogating this false news and has become a source of confusion and rumor for neet pg candidates accross maharashtra...pls have a read the truth below this is the exact story..

20/06/2013 : In-service candidates filed a petition in HC demanding increase of seats from existing 15%(61 degree and 21 diploma seats) in state quota to 25% (101 degrees and 35 diploma in addition, they demanded another 25% degree and diploma seats in all India quota..i.e. grand total of 202 degrees and 70 diplomas(WTF!)

21/06/2013 : state formed a GR in favour of in-service candidates (copy of which was not made available on internet or dmer) this GR was only to be presented to court on next hearing

22/07/2013 we came to know that we are going to lose the seats allotted to us in current state matrix if we dont intervene in the case asap and produce evidence in front of court that MCI guidelines acc to MCI act arent being followed by state gov

23-27 /07/2013 we took the decision to intervene and were trying to gather people and money for the cause

28/07/2013 we met central MARD president Dr Santosh Waghchaure for his guidance and he suggested us lawyer and strategy.Also we created this group to get people together

29/07/2013 we met our lawyer with the copy of MCI rules and regulation who assured us we have a strong case and we should go forward with intervention

1/07/2013 we filed an intervention in HC in the existing case..which was approved and got the first hearing next day only

2/07/2013 Our lawyer presented our side strongly...subsequently in-service candidates' lawyer was supposed to answer to our intervention but he didnt appear in front of court..
STATE GOVT UNDER PRESSURE DUE TO OUR INTERVENTION TO CLEAR THEIR STAND IN FRONT OF HC, SO AS TO WHY MCI RULES WERE NOT FOLLOWED.. MADE A NEW GR IN OUR FAVOUR(WE HAVE THE COPY OF IT NOW) STATING ONLY 50% DIPLOMA SEATS NO DEGREE SEATS ARE TO BE ALLOTTED TO IN-SERVICE CANDIDATES'

3/07/2013 in-service candidates' lawyer AGAIN he didnt appear in front of court..

4/07/2013 THE JUDGEMENT DAY... In-service candidates' lawyer presented 1990 GR stating in-service candidates should get 15% degree and 25% diploma seats in state quota...this GR was available only with archaeological dept and wasnt available online or with DMER or MANTRALAY when we checked before

COURT took into consideration 1) 1990 GR presented by inservice candidates' lawyer
2)our intervention stating MCI guidelines
3)Latest GR dated 2/07/2013 as explained before which was in our favour presented by state gov

COURT DECLARED VERDICT that
State has the right to formulate policy in distribution of seats and they should make a concrete policy within 8 weeks for in-service candidates for next year onwards to avoid such wastage of court and PG aspirants time and energy esp during counselling process

THIS YEAR THE INCREASE IN SEATS AS DEMANDED BY IN-SERVICE CANDIDATES' IS-NOT GOING TO HAPPEN ( :) )
Decision lies with state gov on whether this year's seat distribution will be according to
1)last year's gov policy so that in-service candidates will get 15% of total degree and diploma seats in state quota only OR
2)to follow the latest state gov GR dated 2/07./2013 which states only 50%diploma seats and NO DEGREE seats to be allotted for in service candidates

so we are not losing any seats which were allotted to us in first round but we could gain 61 degree seats if state gov decides to apply 2nd july GR

we should keep checking DMER website for what their decision regarding seat distribution is this year is..

STAY ORDER ON COUNSELING PROCESS HAS BEEN REMOVED
1st selection list could come within 2 days
